The petitioner seeks regular bail in connection with Korha P.S. Case No. 358 of 2021 (arising out of S.T. No. 363 of 2021) instituted for the offences punishable under Sections 363, 366(A) and 34 of the Indian Penal Code.
Learned counsel for the petitioner submits that the petitioner is in custody since 10.09.2021, is a person with clean antecedent and charge-sheet has been submitted in the case. The prosecution case, in short is that on 11.08.2021 at about 10:00 am, while the informant woke up, he found that his minor daughter, aged about 14 years, is missing. In course of

No.8570 of 2022(2) dt.22-06-2022 2/3 search, the informant came to know that co-accused Hareram @ Amit Kumar with the help of other co-accused (family members) including petitioner named in the F.I.R., kidnapped his minor daughter with bad intention. Further, it is submitted by the learned counsel for the petitioner that petitioner is the elder brother of Hareram @ Amit Kumar and allegation against Hareram and all the family members were made on the basis of suspicion. Learned counsel for the petitioner submits that there is love affairs between Hareram @ Amit Kumar and victim girl and the victim girl went with her own sweet will wherein, petitioner has no role. It is also submitted that petitioner is running a bicycle repairing shop and living separately from his father and his brothers at Araria and he has no connection with co-accused Hare Ram @ Amit Kumar. Further, it is submitted by the learned counsel for the petitioner that petitioner is in judicial custody since 10.09.2021.
Learned A.P.P. for the State vehemently opposes the prayer for regular bail of the petitioner.
Considering the fact that the petitioner is in custody since 10.09.2021 and charge-sheet has been submitted in the case, let the petitioner above named be released on bail on fur-
