Victim has already been recovered and her statement under section 164 Cr.P.C was recorded which has been incorporated by the Investigating officer in para 23 of the case diary. Although victim stated about involvement of the petitioner in the alleged crime but it appears that entire allegation centers around against co-accused Meera Devi who happens to be wife of the petitioner.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Kishanganj in Kishanganj P.S.
