The petitioner is aggrieved by the inaction on the part of the District Programme Officer (Establishment), Darbhanga. Learned counsel for the petitioner has drawn the attention of this Court to Annexure-6, the order passed by the Appellate Authority, namely, the Regional Deputy Director of Education, Darbhanga Division, Darbhanga as contained in Memo No. 1191 dated 11.10.2019.

Mr. Baidyanath Thakur, learned counsel for the petitioner submits that notwithstanding the order passed by the Appellate Authority, it has not been acted upon as yet. In a situation, like the aforesaid, the writ application is

Patna High Court CWJC No.3301 of 2020(2) dt.24-02-2020 2/2 disposed of with a direction to Regional Deputy Director of Education, Darbhanga Division, Darbhanga to see that the order dated 11.10.2019 is implemented with immediate effect and those who are defying the order of the Appellate Authority, are proceeded against in departmental proceeding. Necessary decision for implementation of the order dated 11.10.2019 shall be taken by the respondent Regional Deputy Director of Education, Darbhanga Division, Darbhanga within a fortnight from the date of receipt/production of a copy of this order.

As indicated above, the Regional Deputy Director of Education, Darbhanga Division, Darbhanga has all the necessary power to take disciplinary action against all subordinates including theDistrict Programme Officer (Establishment), Darbhanga in the matter of implementation of his order passed in exercise of Appellate Authority. With the aforesaid, the writ application stands disposed of.
