Heard learned counsel for the petitioner and learned A.P.P for the State.

The petitioner has preferred this application for grant of regular bail in connection with Bettiah Town P.S. Case No. 880 of 2022 dated 26.11.2022 registered for the offences punishable under sections 399, 402, 413, 414, 420, 467, 468 and 471 of the Indian Penal Code.

As per the prosecution case, the petitioner and the coaccused persons were assembled for making preparation to commit dacoity near the Kaweri Hotel and they were apprehended by the police and on search a knife, one Oppo mobile and a TVS

Patna High Court CR. MISC. No.9053 of 2023(2) dt.29-04-2023 2/2 motorcycle were recovered from the possession of the petitioner. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. Learned counsel has submitted that the petitioner has no concern with the alleged recovery. Similarly situated co-accused has already been granted bail by the co-ordinate bench vide order dated 21.04.2023 passed in Cr. Misc. No. 11364 of 2023. The petitioner has clean antecedent as stated in para 3 of the bail petition. The petitioner is in custody since 27.11.2022. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner.

Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner above-named, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, Bettiah, West Champaran in connection with Bettiah Town P.S. Case No. 880 of 2022.

The application stands allowed.
