JUSTICE VINOD KUMAR SINHA ORAL ORDER 20-02-2020 The petitioners seek regular bail in connection with Khaira (Nagra) P.S. Case No. 419 of 2019, registered for offences punishable under Sections 30, 38 and 41 of the Bihar Prohibition and Excise Act, 2016.

Allegation is of recovery of 40 litres of liquor and petitioners were arrested on spot.

It has been submitted on behalf of the petitioners that they have falsely been implicated in this case and in fact nothing has been recovered in this case and further petitioner no. 1 has no criminal antecedent, whereas, petitioner no. 2 is accused in one more case and they have been in judicial custody since 03.12.2019.

Having heard both sides, considering the submissions as above, let the petitioners above named, be released on bail on furnishing bail bonds of Rs. 25,000 (Rs. Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise, Saran at Chapra, in connection with Khaira (Nagra) P.S. Case No. 419 of 2019.
