2. The petitioners are in custody since 01.08.2014 and 29.07.2014 respectively, in connection with Mahishi P.S.
Patna High Court Cr.Misc. No.44135 of 2014 (3) dt.03-03-2015 Case No. 126 of 2014 for the alleged offences under Sections 302, 201 and 120B IPC.
3. It is submitted that the petitioners have been falsely implicated on mere suspicion and there is no eye witness to the alleged occurrence. Similarly situated coaccused Shankar Mukhiya and Bacchu Mukhiya have been granted bail by this Court in Cr. Misc. No. 453 of 2015 and Cr. Misc. No. 1344 of 2015, respectively.
4. Having regard to the entirety of the facts and circumstances of the case let the petitioners above named be released on bail on furnishing bail bonds of Rs.10,000/-(ten thousand) each with two sureties of like amount each to the satisfaction of learned Chief Judicial Magistrate, Saharsa in connection with Mahishi P.S. Case No. 126 of 2014 with the condition that the petitioners shall remain physically present in Court on each and every date during trial and in the event of failure on two consecutive dates, their bail bond shall be liable to be cancelled by the learned Court concerned.
