Learned counsel for the petitioners submits that there is case and counter case and there had been an altercation on both sides. There is no specific allegation against petitioners no.1 and 2. It is further submitted that now the informant's side does not want to proceed further in the matter as they realized that the present F.I.R. had been lodged on account of mistake of fact. Considering the aforesaid facts and circumstances of

No.48531 of 2015 (6) dt.20-04-2016 2/2 the case and also the fact that the petitioners have no criminal antecedent, let the petitioners, above named, in the event of their arrest or surrender before the court below within four weeks from today, be released on bail on furnishing bail bonds of Rs.10,000/- each with two sureties of the like amount each to the satisfaction of the S.D.J.M., Biraul at Benipur (Darbhanga), in Kusheshwar Asthan P.S.Case No.109/14 subject to the conditions as laid down under Section 438(2) of Cr.P.C.
