2. Petitioner seeks regular bail in connection with Mirganj P. S. Case No. 430/2024 in a case registered for the offences punishable under Sections 317(5) of the Bharatiya Nyaya Sanhita and Section 30(a) of the Bihar Prohibition and Excise Act.

3. As per the prosecution case, 156 litres county made liquor was recovered from an Alto car bearing registration No. UP53AE1916.

4. Learned counsel for the petitioner submits that no incriminating material has been recovered from conscious possession of the petitioner and he is no way connected with the aforesaid recovery. Petitioner is in custody since 21.10.2024.

5. Learned A.P.P. for the State vehemently opposes the bail application.

6. Considering the nature of accusation and period of custody, the bail application is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional District & Sessions JudgeIV-cum-Exclusive Special Court No. II, Gopalganj in connection with Mirganj P.
