JUSTICE VINOD KUMAR SINHA ORAL ORDER 05-02-2020 Petitioner seeks bail in connection with Saharsa Sadar P.S. Case No. 551 of 2019, corresponding to Sessions Trial No. 203 of 2019, registered for the offence punishable under Section 392 of the Indian Penal Code.

Allegation is of snatching of Bolero vehicle by some miscreants and later on name of petitioner has transpired in the confessional statement of co-accused and at the instance of petitioner Bolero vehicle was recovered.

Submission of learned counsel for the petitioner is that the vehicle was recovered from an open place and he is in custody since 22.6.2019 and charge has already been framed in this case.

Heard learned APP, who has opposed the prayer for

Patna High Court CR. MISC. No.6775 of 2020(2) dt.05-02-2020 2/2 bail stating that recovery was made at the instance of petitioner and he is accused in one more case.

In view of above facts and circumstances, I am not inclined to grant bail to the petitioner at this stage. However, if the trial is not concluded within a period of six months, the petitioner is at liberty to renew his prayer for bail. This application is, accordingly, dismissed.
