The petitioner apprehends his arrest in a case registered for the offence under Section 379 of the Indian Penal Code.

As per the prosecution case, the petitioner is alleged to have committed theft of motorcycle of the informant. It is submitted on behalf of petitioner that only on suspicion, this petitioner has been made accused in this case. No stolen article has been recovered from the possession of this petitioner. Petitioner and informant are next door neighbours and nobody has seen this petitioner stealing the motorcycle in question. Petitioner has also registered a case against informant & others, vide Lodipur P.S. Case No. 106 of 2021.

Patna High Court CR. MISC. No.8085 of 2022(2) dt.02-08-2022 2/2 Learned A.P.P. for the State has opposed the bail petition.

Considering the aforesaid facts and circumstances, let the above named petitioner, in the event of his arrest/surrender within a period of six weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. - IV, Bhagalpur in connection with Lodipur P.S. Case No. 105 of 2021 (G.R. No. 2545 of 2021), subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
