2. The petitioner is in custody since 18.08.2014 in connection with Hilsa P.S. Case No. 165 of 2013 for the offence alleged under section 302 read with Section 34 of the Indian Penal Code.
3. It is submitted that the petitioner is innocent and it is Krishna Sao co-accused who assaulted the deceased on his chest with big stone leading to death. Co-accused Pramod Sao @ Dharmraj Kumar has already been granted anticipatory bail in similar circumstances. The petitioner claims clean antecedent.
4. Having regard to the entirety of the facts and circumstances of the case, let the petitioner (Subodh Sao) be released on bail on furnishing bail bond of Rs.10,000/-(ten

No.43157 of 2014 (3) dt.03-03-2015 2/2 thousand) with two sureties of like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Hilsa (Nalanda) in Hilsa P.S. Case No. 165 of 2013 with additional condition that the petitioner shall remain personally present on each and every date during the trial and if he fails to do so on two consecutive dates, his bail bond will be liable to be cancelled by the Court concerned.
