JUSTICE VINOD KUMAR SINHA ORAL ORDER 05-04-2019 Petitioner seeks bail in anticipation of his arrest in connection with Complaint Case No. 1487C of 2017 in which cognizance has been taken under Section 498A IPC and Sections 3/4 of Dowry Prohibition Act.
Allegation against the petitioner is of subjecting his wife to cruelty with respect to demand of dowry. Submission of learned counsel for the petitioner is that as a matter of fact opposite party No.2 has already married with the cousin brother of the petitioner, which will appear from Annexure-4, the statement of the opposite party No.2 before the Magistrate in a case of kidnapping.
Heard learned APP and learned counsel for the
Patna High Court CR. MISC. No.7454 of 2019(3) dt.05-04-2019 2/2 complainant, who has opposed the prayer for anticipatory bail on the ground that a case for kidnapping was lodged by the petitioner in which she was forced to make such statement and further petitioner has married with another lady. Having heard both sides and without going into the claim and counter claim of the petitioner, the provisional bail granted to the petitioner vide order dated 8.2.2019 is, hereby, confirmed, in connection with Complaint Case No. 1487C of 2017, pending in the court of S.D.J.M., Jamui, subject to the condition that if any maintenance case is filed by opposite party No.2 the petitioner has to co-operate in disposal of the same, otherwise opposite party No.2 will be free to move for cancellation of bail bonds of the petitioner.
