Petitioner is neither named in the first information report nor stolen mobile was recovered from his possession rather it was Joyti Gupta who handed over stolen mobile to the police disclosing that she had purchased the aforesaid mobile from the petitioner. Petitioner does not have any criminal antecedent and he is languishing in jail custody since 26.8.2015.

Accordingly, petitioner is directed to be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Addl. Chief Judicial Magistrate, Danapur in Rupaspur P.S. Case no. 100/2012.
