This application for grant of regular bail arises out of Phulparas P.S. Case No. 257 of 2014 corresponding to G.R. No. 1500 of 2014, disclosing offences under Section 395 of the Indian Penal Code.
The petitioner is in custody since 04.02.2015. It is submitted on behalf of the petitioner that his name has surfaced on the basis of statement of local shopkeepers. He has further submitted that another co-accused person namely, Gauri Shanker Gautam alias Gautam Yadav @ Gauri Shankar Yadav, named in the First Information Report, has been granted regular bail by this Court by an order dated 19.08.2015 passed in
Patna High Court Cr.Misc. No.46642 of 2015 (2) dt.15-10-2015 2/2 Criminal Miscellaneous No. 23386 of 2015.
Keeping in view the submission as above, this application is allowed.
Let the petitioner, above-named be released on bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Jhanjharpur, DistrictMadhubani in connection with Phulparas P.S. Case No. 257 of 2014 corresponding to G.R. No. 1500 of 2014.
This is subject to the condition that the petitioner shall present himself before the police/Court, as the case may be, as and when required and in the event of failure on his part to appear before the Court on two consecutive occasions, his bail bonds shall be liable to be cancelled.
