The petitioner seeks bail in a case registered for the offences punishable under Sections 25(1-b)a, 26 and 35 of the Arms Act.

Learned counsel for the petitioner submits that the petitioner has antecedent of one case and allegation is of recovery of one country-made pistol along with two live cartridges and one empty magazine from the petitioner. Learned counsel for the petitioner submits that the petitioner is a student and that would be evident from Annexure2 to the bail application and he has been falsely implicated in the present case for reasons best known to the informant and is in custody since 18.10.2021 and charge-sheet has been

Learned A.P.P. for the State opposes the prayer for bail of the petitioner.

Considering the fact that the petitioner is in custody 18.10.2021 and charge-sheet has been submitted in the case, let the petitioner above named be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Narpatganj (Basmatiya) P.S. Case No. 438 of 2021 with a condition that one of the bailors of the petitioner shall be his father, Krishan Mohan Yadav.
