The petitioner is languishing in custody since 23.09.2013 in a case registered for the offences punishable under Sections 363 and 366A of the Indian Penal Code. The accusation is of kidnapping the minor daughter of the informant. In 164 Cr.P.C. the victim has named this petitioner as a person who abducted her. It is submitted by learned counsel for the petitioner that the FIR was lodged after 15 days of the alleged abduction. In 164 Cr.P.C. statement the victim has stated that the petitioner did not misbehave with her and she was in the company of this petitioner for ten days. The medical report suggests the age of the victim between 18-19 years.

Considering the delayed lodging of the case, inconsistency in the statement of victim girl and the petitioner has criminal antecedent, let the above named petitioner, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-IInd, Gaya in connection with Sessions Trial No. 308 of 2014/207 of 2014 (S.J.) arising out of Wazirganj P.S. Case No. 454 of 2013.
