Learned counsel for the petitioner is expected to honour his undertaking to remove the defects, as pointed out by the office, when called upon to do so by the office. The petitioner is/are apprehending his/their arrest in connection with Bihar P.S. Case No. 592 of 2020 for the offence registered under Sections 147, 148, 149, 307, 353, 323 and 324 of the Indian Penal Code.
The prosecution case in brief is that on information, police force reached at the place of occurrence and saw that both parties are quarrelling and firing was also going on. On seeing the police force, accused persons tried to flee away but with the help of police force, two person namely, Kanhaiya Das and Ravi Ravidas were arrested. On search, pistol and cartridge was
Patna High Court CR. MISC. No.18230 of 2021(2) dt.13-12-2021 2/2 recovered from both the accused persons. In the alleged incident, accused Ravi Ravidas sustained injury and he was hospitalized for treatment.
Learned counsel for the petitioner submits that the petitioner is innocent and he has falsely been implicated in the present case. It is further submitted that name of the petitioner came into light on the confessional statement of co-accused persons which has no evidentiary value. It is further submitted that there is general and omnibus allegation against the petitioner and he has no criminal antecedent. Considering the facts and circumstances of the case, let the petitioner, above named, in the event of his/their arrest/surrender before the court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Nalanda (Biharsharif) in connection with Bihar P.S. Case No. 592 of 2020, subject to the conditions as laid down under Section 438(2) of the Cr. P.C. (Sunil Kumar Panwar, J) Jagdish/- U T
