JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER (Per: HONOURABLE THE CHIEF JUSTICE) 21-03-2018 Petitioner whose antecedents are not known, but is only a resident of the village in question, has filed this writ petition under Article 226 of the Constitution making a grievance that in the Dr. Rajendra Prasad, Higher Secondary School, at Hathwan, DistrictGopalganj, various irregularities and illegalities are being committed and in spite of a report by the District Education Officer, Gopalganj,

Patna High Court CWJC No.3790 of 2018(3) dt.21-03-2018 2/2 no action is taken, the petition has been filed seeking an enquiry into the functioning of the institute in question. However, on going through the writ petition, we find that primarily, the petition has been filed targeting respondent no.12, an Assistant Teacher, working in the institute and there seems to be some grievance with regard to appointment and working of respondent no.12 in the school in question. That apart, the petitioner refers to Annexure-18 to say that the District Education Officer, Gopalganj has pointed out various irregularities in the functioning of the school and in spite thereof, no action has been taken. If that be so, we direct respondent nos.

2 and 3, the Principal Secretary and the Director, Secondary Education, Government of Bihar, Patna to look into the grievance of the petitioner and proceed to take action with the regard to the school in question in accordance with law. Needless to emphasise that we have not expressed any opinion on the merits of the allegations made and it is exclusively for the respondent nos.2 and 3 to proceed in accordance with law. With the aforesaid, the writ petition stands disposed of.
