2. The petitioner seeks regular bail in connection with Bairiya P.S. Case No. 162 of 2023, lodged on 06.06.2023 under Sections 341, 323, 307, 504, 506, 34 of the Indian Penal Code and later on added section 302 of the IPC.
3. As per the prosecution case, FIR has been lodged against nine named accused persons including the present petitioner. The allegation is that the petitioner and other accused persons came and started assaulting the informant. Co-accused Ramavtar Singh gave iron rod blow on the head of the informant and when his brother came to save him, co-accused Raja Ram Sah assaulted him with iron rod on his head.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. Counsel also submits that the name of the petitioner has been figured in the accused column of the FIR and his name is there only as a member of mob and there is nothing specific against the petitioner nor any act or overtact has been alleged in the FIR. Counsel further submits that on the same ground of similar allegations, two co-accused persons have been granted bail by the co-ordinate bench of this Court vide orders dated 24.01.2024 and 07.02.2024 passed in Cr. Misc. Nos. 824 of 2024 and 2839 of 2024 respectively.
5. Learned counsel for the petitioner submits that the antecedent of the petitioner is clean and he is in custody since 06.11.2023. Counsel also submits that the charge-sheet has already been filed in this case.
6. Learned APP for the State opposes the prayer for bail of the petitioner.
7. In the present facts and circumstances of this case and the submissions made above considering the antecedent of the petitioner, let the petitioner above named be granted bail, on furnishing bail bonds of Rs.30,000/- (Rupees Thirty thousand) with two sureties of the like amount each to the
