JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 14-10-2015 Heard learned counsel for the petitioners and the learned APP for the State.
This is an application for grant of regular bail on behalf of the petitioners who are accused in connection Bonchaha PS Case No. 22 of 2015 for the alleged offences punishable under Sections 8/20(b), ii(c), 22, 29 of the Narcotic Drugs and Psychotropic Substances Act, 1985 and Section 34 of the Indian Penal Code.
The petitioners had earlier approached this Court for grant of regular bail by filing Cr. Misc. No. 14455 of 2015 which came to be rejected by an order dated 1.6.2015. In view of the provisions under the NDPS Act, 1985, I am not inclined to consider the present application filed merely four months after
Patna High Court Cr.Misc. No.47980 of 2015 (2) dt.14-10-2015 2/2 rejection of the earlier bail application.
This application is accordingly rejected.
It is submitted on behalf of the petitioners that petitioner no.1, namely Nashima, is carrying pregnancy which is in advanced stage.
It goes without saying that the concerned Jail Authorities shall be taking required steps to ensure all necessary helps to the petitioner.
