JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 13-12-2021 Heard learned counsel for the petitioners and the learned Additional Public Prosecutor appearing for the State. Learned counsel for the petitioners is expected to honour his undertaking given in the instant case for depositing the requisite Court fee and to remove the defects as pointed out by the office when called upon to do so by the office. The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 302, 201 and 34 of the Indian Penal Code.

It was submitted that the deceased was mentally ill person since long period. Many times she disappeared from the house. Some times her family members or villagers search her or some times she returned herself. She went her maiyka

Patna High Court CR. MISC. No.18383 of 2021(2) dt.13-12-2021 2/2 without any information and after some time she again disappeared from the house. The information was given to the informant. It is further alleged that the petitioners are falsely implicated in this case. The petitioners have no concern with the deceased and her husband. Petitioners are father-in-law, mother-in-law and brother-in-law of the deceased and they are living separately. It is also submitted that the husband of the deceased is languishing in jail.

In the facts and circumstances of the case, let the petitioners, above named, in the event of their arrest or surrender before the Court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (rupees ten thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, East Champaran at Motihari, in connection with Govindganj P.S. Case No. 270 of 2020, subject to the conditions as laid down under Section 438(2) of the Criminal Procedure Code.
