The petitioner has prayed for regular bail in a case registered for the offence punishable under section 394 of the Indian Penal Code.

As per prosecution case, the informant alleged that the petitioner and co-accused persons assaulted him and snatched his bag containing cash of Rs. 600/- and other articles while he was going to bus stand from Bazar Samiti after submitting the ballot box. It is further alleged that co-accused person was apprehended and upon his confession name of the petitioner dragged in this case.

Learned counsel for the petitioner submits that the

The petitioner was not apprehended on the spot and merely on the basis of confessional statement of the co-accused, he has falsely been implicated in this case. It is further submitted that stolen motorcycle was not recovered from his possession rather it was recovered from co-accused, namely, Deepak Kumar @ Sonu Sahni. the petitioner is languishing in judicial custody since 14.05.2022.

Learned APP appearing for the state has opposed the prayer of regular bail.

Having heard learned counsel for the parties and considering the facts and circumstances of the case as well as custody of the petitioner, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Sadar (Mobbi O.P.) P.S. Case No. 518 of 2021 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate,Ist Class, Darbhanga.
