JUSTICE VINOD KUMAR SINHA ORAL ORDER 06-02-2020 Petitioner seeks regular bail in connection with Nautan Police Station Case No. 228 of 2019 registered for the offence(s) punishable under Sections 30 (A) and 41 (i) of the Bihar Prohibition and Excise Act, 2016.

Allegation is that the petitioner is said to be the owner of the Bolero vehicle and there is recovery of 1762 liters of liquor from the Bolero vehicle and the person arrested on the spot taken the name of the petitioner.

Submission of the learned counsel for the petitioner is that he has sold the vehicle to one Deepak Gupta. Petitioner was arrested along with the vehicle on 14.12.2018 and moreover, he has no criminal antecedent. He is in custody since 08.01.2020. Heard learned A.P.P. also.
