JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 14-10-2015 Heard learned counsel for the petitioner and learned Assistant Public Prosecutor for the State. This application for grant of regular bail arises out of Fatuah P.S. Case No.317 of 2015, disclosing offences under Sections 420, 467, 468 and 471/34 of the Indian Penal Code.

The petitioner is a lady and has been made accused on the ground that she got herself selected for the post of Anganbari Sevika for Anganbari Centre, Kolbar,

Patna High Court Cr.Misc. No.46579 of 2015 (2) dt.14-10-2015 2/3 Fatuah, Patna, on the basis of certificate, said to have been issued by the Bihar Sanskrit Shiksha Board, which was subsequently found to be forged.

Learned counsel, appearing on behalf of the petitioner, submits that she being a lady is not likely to tamper with the evidence in view of the nature of allegation made against her.

Be that as it may, in the facts and circumstances of the case and since the petitioner is a lady, this application is allowed.

The petitioner, abovenamed, is directed to be released on bail on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Sri P.K. Ratan, Judicial Magistrate, Patnacity, Patna, in connection with Fatuah P.S. Case No.317 of 2015.

This is subject to the condition that the petitioner shall present herself before the police/Court, as the case may be, as and when required, and in the event of failure on her part to appear before the Court, on two consecutive occasions, her bail bond shall be liable to be cancelled.
