The petitioner has filed the instant application for grant of regular bail in connection with Daudpur P.S. Case No. 100 of 2021 registered under sections 302, 201 and 34 of the Indian Penal Code.

As per prosecution case, after getting information about a dead body, the informant reached at the place of occurrence and found a dead body of lady was packed in sack which was in a well. Thereafter, this case has been registered against unknown.

Learned counsel for the petitioner submits that the

Patna High Court CR. MISC. No.10150 of 2023(2) dt.18-04-2023 2/3 petitioner is innocent and has committed no offence. He has falsely been implicated in this case. The petitioner is brotherin-law of the deceased due to which he has falsely been implicated in this case on the basis of suspicion. It is further submitted that the petitioner has no concern with mess and business of the deceased as well as from her husband and lives separately from them. The husband of the deceased is already in judicial custody. A statement has been made in para-3 of this petition that the petitioner has got no criminal antecedent. Moreover, he is languishing in judicial custody since 03.11.2022. Similarly situated other co-accused person has already been granted bail by this Court vide order dated 12.04.2023 in Cr. Misc. No. 8130 of 2023.

The application for bail is opposed by learned APP for the State.

Having heard learned counsel for the parties and taking into consideration the facts and circumstances of the case as well as the custody of the petitioner, the Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail in connection with Daudpur P.S. Case No. 100 of 2021 on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) with two sureties of the
