The writ petition was filed for a direction to the respondent authorities including the Mines and Geology Department as also the Bihar Public Service Commission to consider the candidature of the petitioners on their qualification as M.Tech in Applied Geology which admittedly is not one of the subject(s) prescribed in the advertisement.

The issue raised was noted and time was granted to the learned counsel appearing for the Mining Department as well as the

Patna High Court CWJC No.17854 of 2017 dt.19-12-2017 Bihar Public Service Commission to seek instructions and when a counter affidavit is filed on behalf of the State in its Mines and Geology Department which encloses a letter dated 7.12.2017 of the Under Secretary, Mines and Geology Department addressed to the Secretary, Bihar Public Service Commission communicating the approval of candidature of the applicants holding degree in M.Tech. (Applied Geology), M.Tech in Geological Technology, M.Sc. in Applied Geology and Geo Informatics as well as M.Sc. (Geology Science).

The advisory issued by the Mines Department to the Bihar Public Service Commission in expanding the qualification(s) prescribed which includes the qualification possessed by the petitioners, satisfies them and the writ petition is disposed of accordingly.
