JUSTICE ADITYA KUMAR TRIVEDI ORAL ORDER 02-11-2015 Heard learned counsel for the petitioner as well as learned APP for the State.

Deceased, Rama Kant Jha while was returning from the village market and as soon as reached near the house of Panchanand Jha, Panchanand Jha, Shanti Devi and Anant Sharma (petitioner) pounced upon him wherein Panchanand Jha gave knife blow over head of Rama Kant Jha while Shanti Devi gave brick blow. At that very moment, as alleged, Anant Sharma, petitioner had caught hold of deceased Rama Kant Jha. The deceased was taken to Sadar Hospital and then to PMCH where during course of treatment, he died. Informant Kamla Kant Jha, son of deceased filed a written report to this effect.

From the order impugned, it is evident that same set of allegation has been attributed by the prosecution during course of

Patna High Court Cr.Misc. No.48559 of 2015 (2) dt.02-11-2015 investigation.

Since petitioner happens to be non assailant, let petitioner, Anant Sharma is directed to be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Saharsa in connection with Sour Bazar PS Case No. 309/2014.
