2. The petitioner seeks bail in connection with Bhagalpur Mahila P.S. Case No.70 of 2024 registered for the offence punishable under Sections 65(1), 351(2) and 352 of the Bharatiya Nyaya Sanhita.
3. As per the prosecution case, the petitioner is alleged to have raped the victim girl.
4. Learned APP appearing for the State and learned counsel for the informant have opposed the prayer for regular bail of the petitioner.
5. From the statement of the victim girl, it appears that
Patna High Court CR. MISC. No.8042 of 2025(4) dt.02-07-2025 2/2 she was a consented party to the relationship. The petitioner is in custody since 21.10.2024.
6. Considering the aforesaid facts and circumstances of the case and submissions of learned counsel for the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned District and Additional Sessions Judge-VI-cum- Exclusive Special Court, POCSO, Bhagalpur/concerned Court in connection with Bhagalpur Mahila P.S. Case No. 70 of 2024.
