Petitioner is not named in the first information report nor any witness claimed to have seen the actual killing of the deceased. Furthermore, it would appear from perusal of the impugned order that name of the petitioner came on the basis of CDR of the mobile of the petitioner and thereafter, petitioner was arrested and his confessional statement was recorded.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of Sri S.K. Mishra, Judicial Magistrate, Ist Class, Aurangabad/ concerned court in Kasma P.S. Case no. 50/2015.
