Mr.Raj Kishore Singh ====================================================== CORAM: HONOURABLE MR. JUSTICE SANJAY PRIYA ORAL ORDER 14-02-2019 Heard the learned counsel for the petitioner, informant and the learned A.P.P. for the State.

The petitioner seeks bail in Sonbarsa P.S. Case No. 154/2015, instituted for offences under Section(s) 498(A) of the Indian Penal Code read with Section 3⁄4 of D.P. Act. Learned counsel for petitioner has submitted that wife of petitioner does not want to live with him. Learned counsel for informant has submitted that after birth of female child her husband is totally neglecting them. He is not looking after them. He is not making payment of any maintenance amount. Informant wants to live with this petitioner but petitioner is not ready to keep her.

In such circumstances, this bail petition is disposed off with direction to the petitioner to file affidavit at the time of filing

Patna High Court Cr.Misc. No.8088 of 2019(2) dt.14-02-2019 2/2 bail bond that he will pay Rs. 2,000/- per month to the informant and her female child as maintenance. Petitioner will continue to make payment of aforesaid amount by 15th of every month and if possible, informant will give account number to the petitioner. Petitioner will credit aforesaid amount in the account of informant. It is made clear that petitioner will continue to make payment of maintenance amount till final disposal of Maintenance Case.

In the event petitioner commits default in making payment of single installment to the informant, his bail bond will be cancelled.

The informant will file Maintenance Case before learned Principal Judge, Family Court, Sitamarhi, if not filed, within a period of one month of passing of this order. The informant will take appropriate action for passing final order in the Maintenance Case.

The Principal Judge, Family Court, Sitamarhi will make all efforts to pass final order in maintenance case within nine months from the date of filing of maintenance case. (Sanjay Priya, J) rakhi/- U T
