JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 07-10-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner happens to be mother- in-law of the deceased and is languishing in jail custody since 06.05.2015 in a case registered under section 304B and 120B/34 of the Indian Penal Code.

The first information report does not disclose any specific allegation of making illegal demand as well as torturing against the petitioner and furthermore, the impugned order reveals that deceased died due to consumption of poison. Considering the aforesaid facts and circumstances as well as submissions of the parties and also taking note of this fact

Patna High Court Cr.Misc. No.46962 of 2015 (2) dt.07-10-2015 2/2 that the husband of the deceased has already been sent to jail custody, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Madhepura in connection with Singheshwar P.S.Case No. 79 of 2015.
