The petitioner seeks bail in a case registered for the offence under Section 304(B)/34 of the Indian Penal Code. As per the prosecution case, this petitioner alongwith other co-accused persons killed the daughter of the informant due to non-fulfillment of demand of dowry.

Petitioner happens to be dewar (brother-in-law) of the deceased and he is separate from the deceased in mess and property. There is general and omnibus allegation and thrust of the accusation is against husband of the deceased, who is already in custody. Petitioner is in custody since 12.09.2021. Investigation is complete.

Learned A.P.P. for the State has opposed the bail petition.

Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhojpur (Ara) in connection with Udwantnagar P.S. Case No. 393 of 2021.
