As prayed for, let the learned counsel appearing for the petitioner remove the defect(s), as pointed out by the office vide its notes dated 19.02.2021, within four weeks of starting of Court proceeding in physical mode in normal course.

This application is filed for Modification of order dated 05.07.2019 passed in Cr. Misc. No. 77392 of 2018. Learned counsel appearing on behalf of the petitioner submits that vide order dated 05.07.2019 passed in Cr. Misc. No. 77392 of 2018, the petitioner was directed to be released on bail in the event of his arrest or surrender before the court below within the period of six weeks on furnishing

No.13965 of 2021(2) dt.23-06-2021 2/2 the bail bond of Rs. 10,000/- (Ten thousand) with two sureties of like amount each to the satisfaction of the learned Chief Judicial Magistrate, Katihar, in connection with Manihari P.S. Case No. 44 of 2013, subject to the conditions laid down under Section 438(2) Cr.P.C., but due to some unavoidable circumstances, petitioner could not surrender before the court below within the stipulated period.

In such view of the matter, the time to surrender of petitioner, as per order dated 05.07.2019 passed in Cr. Misc. No. 77392 of 2018, is further extended by four weeks from today in connection with aforesaid case.

Accordingly, the modification application is allowed and the order dated 05.07.2019 passed in Cr. Misc. No. 77392 of 2018 is modified to the above extent. (Rajendra Kumar Mishra, J) manish/- U T
