The present application has been preferred for the following relief(s):- That is an application for set aside the order dated 20.10.2017 vide letter no. 700 issued by the District Land Acquisition Officer, Gaya who directed to stop the operation of withdrawal of amount to the account of the petitioner and also directed to refund the amount a sum of Rs.

3626594.00 which has been paid as compensation of the construction as well as land in the land acquisition process.

3. Learned counsel for the State submits that the person (Dharmendra Kumar), who made the objection has not even been made party/respondent in the case and as such, the matter is fit to be dismissed for non-joinder of necessary party.

4. At this stage, learned counsel for the petitioner submits that pursuant to the notice issued by the District Land Acquisition Officer, Gaya, he shall be participating/co-operating before him.

5. Granting said liberty to the concerned authority, the writ petition is disposed of.
