====================================================== CORAM: HONOURABLE MR. JUSTICE SANJAY PRIYA ORAL ORDER 06-03-2019 Heard learned counsel for the petitioner and the State.

Prayer of the petitioner for grant of anticipatory bail was earlier rejected by this Court vide order dated 3.1.2018 passed in Cr. Misc. 37521 of 2017. The petitioner was directed by that order to surrender before the court below and make prayer for regular bail.

Counsel for the petitioner pointed out Annexure 3 and 4 and submits that construction work has already been completed and due amount has been adjusted. This Court is of the view that these are good grounds for grant of regular bail. The earlier anticipatory bail application was rejected by this Court on merit.

Therefore, this Court is not inclined to grant

Patna High Court CR. MISC. No.11528 of 2019(3) dt.06-03-2019 2/2 anticipatory bail to the petitioner on these grounds. Petitioner is directed to surrender in the court below and make prayer for regular bail which will be considered by the court below in accordance with law without being prejudiced by this order, and if possible, shall be disposed of on same day.
