JUSTICE ANJANI KUMAR SHARAN ORAL ORDER 04-08-2021 Heard the parties through virtual Court proceedings. The petitioner seek bail in a case registered for the offence punishable under Sections 302/34 of the Indian Penal Code.

In pursuance to the order dated 07.07.2021, status report of trial was called for in connection with Sessions Trial No. 07/2019 arising out of Hulasganj P.S. Case No.18/2018 has been received from learned A.D.J.-VII, Jehanabad and kept at Flag 'A', in which it is stated that after framing of charge out of 09 prosecution witnesses cited in the charge sheet 07 witnesses has been examined. Due to COVID-19 affect, 02 official witnesses who are the Investigating Officers of the case have not been examined in this case uptill now. If the court is running in regular mode then trial may be concluded within two months.

Patna High Court CR. MISC. No.20888 of 2021(3) dt.04-08-2021 2/2 Considering the present stage of trial, I am not inclined to enlarge the petitioner on bail. Accordingly, the prayer for bail is rejected in connection with Sessions Trial No. 07.2019 arising out Hulasganj P.S. Case No.18/2018 pending before the Court of the learned Additional District and Sessions Judge-VII, Jehanabad.

Accordingly, the application is dismissed. However, the Trial Court is directed to conclude the trial as expeditiously as possible within a period of four months from the date of initiation of normal physical proceeding and / or through Video Conferencing.
