JUSTICE SUDHIR SINGH ORAL ORDER 24-11-2015 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted under Sections 395 and 412 of the Indian Penal Code. As per prosecution case, some unknown persons committed dacoity in the house of the informant and took away valuable articles worth Rs.5 lacs. The name of the petitioner has come on the basis of confessional statement of the accused. It has been submitted on behalf of the petitioner that he is in custody since 19.3.2015. Chargesheet has been submitted in the present case. There is no allegation of tampering of evidence against the petitioner. Petitioner is not named in the F.I.R. It is a case of single identification. There is no recovery of any incriminating article. It is further submitted that petitioner may be released after completion of nine months in custody from 19.3.2015.

On behalf of the State, it is submitted that petitioner's name has come in course of investigation. It is a case of single

Considering the aforesaid facts and circumstances, let the above named petitioner be released after completion of nine months in custody from 19.3.2015 on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of learned A.D.J.-III, Khagaria, in connection with S. Tr. No. 200 of 2015 arising out of Chautham P.S. Case no. 36 of 2015.
