The petitioner is in custody since 24.5.2013 in connection with Bochahan PS Case No. 70/2013 registered for the offence under section 395 of the Penal Code.
It is submitted on behalf of the petitioner that he was not named in the F.I.R. but when he was in custody in connection with Ahiyapur PS Case No. 208/2013, he was remanded in connection with the present case. The said remand was on the basis of confessional statement made by one coaccused Biswanath Rai who has already been extended the privilege of bail by this court in Cr. Misc. No. 48862/2013 on 25.11.2013. It is further submitted on behalf of the petitioners that
Patna High Court Cr.Misc. No.13588 of 2014 (7) dt.24-12-2014 2/2 after his arrest he has neither been put on T.I. parade nor has been any recovery from his possession.
Considering the aforementioned submissions and also the fact that the petitioner has been in custody in connection with the present case for more than one and half year, let petitioner above named be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Muzaffarpur in connection with Bochahan PS Case No. 70/2013.
