Mr.Parmeshwar Mehta ====================================================== CORAM: HONOURABLE MR. JUSTICE MOHIT KUMAR SHAH ORAL ORDER 14-02-2019 Heard the learned counsel for the petitioner and the learned counsel for the State.

The petitioner seeks regular bail in connection with Shahkund PS case no. 250 of 2018 registered for the offence punishable under Section 7 of the Essential Commodities Act.

The allegation as per the informant who is the Block Supply Officer, Shahpur is that while he was on patrolling, he inspected the rice laden pick-up van which had already been apprehended by the police and 60 gunny bags of rice were found. The driver of the said vehicle, who is the petitioner herein, was apprehended and he disclosed that the said rice was being transported from P.D.S. shop of the co-accused Ram Pratap Paswan and thereafter, the said shop

Patna High Court Cr.Misc. No.8615 of 2019(2) dt.14-02-2019 2/2 was also raided and discrepancy was found as far as the stock register and stock available in the said shop is concerned. The learned counsel for the petitioner has submitted that the petitioner is merely the driver of the pick-up van and he was carrying the load as per the direction of the owner of the rice bags to be ferried, hence there is no complicity of the petitioner in the present case. It is further submitted that the petitioner is having clean antecedent and he is languishing in custody since 29.11.2018.

Having regard to the facts and circumstances of the case, I deem it fit and proper to enlarge the petitioner on regular bail.

Accordingly, the abovenamed petitioner is directed to be enlarged on regular bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional District & Sessions Judge V, Bhagalpur in connection with Shahkund PS case no. 250 of 2018.
