The present petition has been filed for modification of the order dated 15.12.2021 passed in Cr. Misc. No. 17505 of 2021.

It is submitted by learned counsel for the petitioner that the petitioner was granted anticipatory bail on his submission that complainant is residing with him with full dignity and honour and the learned Court below was directed to accept the bail bonds of the

Patna High Court CR. MISC. No.15792 of 2022(3) dt.12-04-2023 2/3 petitioner after satisfying with the complainant that she is presently residing with her husband as wife with full dignity and honour. The complainant is still residing in her matrimonial house with full dignity and honour but she is reluctant to accompany with the petitioner before learned Court below and affirm that she is residing in her matrimonial house as she is only interested to put the petitioner behind bar.

Learned counsel appearing on behalf of the informant though accepted that complainant is residing in her matrimonial house but he denies that petitioner is maintaining the complainant and keeping her as wife with full dignity and honour. The informant claims some interim maintenance from the petitioner.

Considering the fact that complainant at present is residing in her matrimonial house with full dignity and honour and this fact has not been controverted by learned counsel appearing on behalf of the complainant, let the last paragraph of the order

Patna High Court CR. MISC. No.15792 of 2022(3) dt.12-04-2023 3/3 dated 15.12.2021 directing the learned Court below to allow the bail bonds of the petitioner on production of the complainant and after satisfying that she is presently residing with her husband as wife with full dignity and honour, be deleted.

The learned Court below is directed to accept the bail bonds of the petitioner.

The period of surrender of the petitioner is hereby extended for a further period of four weeks from today.

The order dated 15.12.2021 passed in Cr. Misc. No. 17505 of 2021 is modified to the extent as indicated above.
