JUSTICE RAKESH KUMAR ORAL ORDER 04-04-2019 Heard Sri Ansul, learned counsel for the petitioner and Sri Choubey Jawahar, learned Addl. Public Prosecutor. The sole petitioner, who is named in the F.I.R. in Goh P.S. Case No. 139 of 2018 registered for the offence under Sections 406, 409, 420 of the Indian Penal Code on an accusation of misappropriation of Government fund, has approached this Court for anticipatory bail.

Learned counsel for the petitioner tried to persuade the Court that there is no misappropriation of Government fund. Sri Ansul, learned counsel for the petitioner submits that it is true that F.I.R. was lodged against the petitioner on an accusation of misappropriation of Government fund but it is a fact fact that he has already completed the construction work.
