The petitioners apprehends their arrest in connection with Khagaria P.S. Case No.781 of 2018, G.R. No.3153 of 2018 registered under Sections 341, 323, 504, 506, 342, 384, 34 of the Indian Penal Code and Section 37(c) of Bihar Prohibition and Excise Act, 2016.

The informant alleged that while he was walking Banti Kumar abused and asked him to pay Rs.200/- for taking wine. On refusal accused persons assaulted the informant and Banti Kumar took out Rs.800/- from the pocket of the informant.

The learned counsel for the petitioners submits that the petitioners are next door neighbour of the informant. Some

Patna High Court Cr.Misc. No.9866 of 2019(2) dt.19-02-2019 2/2 verbal altercation took place on account of some petty dispute but the allegation of demand of extortion is falsely made. Now, the case has already been compromised and the informant filed the compromise petition.

Considering the facts aforesaid and the nature of allegation made against the petitioners and the fact that the informant has already compromised, the petitioners, above named, in the event of their arrest or surrender before the learned Court below within a period of four weeks from the date of receipt / production of a copy of this order are directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned In-charge, Special Judge (Excise), Khagaria in connection with Khagaria P.S. Case No.781 of 2018, G.R. No.3153 of 2018, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure. (Prabhat Kumar Jha, J) sanjeev/- U T
