====================================================== CORAM: HONOURABLE MR. JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 06-05-2019 Heard learned counsel for the petitioner and the learned A.P.P. for the State.
The petitioner apprehends his arrest in connection with Masrakh P.S. Case No.360 of 2017 registered under Sections 413 and 414 of the Indian Penal Code. Learned counsel appearing on behalf of the petitioner submits that it would appear from the F.I.R. that Rohit Kumar Singh was apprehended by the police with looted motorcycle. Thereafter, the confessional statement of Rohit Kumar Singh was recorded in which he confessed that, earlier, he had looted one motorcycle, which was kept at the garage of the petitioner. Thereafter, police went there and seized one motorcycle and the petitioner admitted that the seized motorcycle was kept by

No.8003 of 2019(4) dt.06-05-2019 2/2 Rohit Kumar Singh in his garage and the petitioner was also made seizure list witness in that case but, later on, the Superintendent of Police raised suspicion against the petitioner about having his hand in the loot of the motorcycle by Rohit Kumar Singh. Except that, nothing has been collected by the Investigating Officer against the petitioner in course of investigation. The petitioner has no criminal antecedent. Having considered the facts and the circumstances of the case, let the petitioner, above named, in the event of his arrest or surrender by him within six weeks from today, be enlarged on bail on his furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate-VI, Saran, Chapra, in connection with Masrakah P.S. Case No.360 of 2017, subject to the conditions laid down under Section 438(2) Cr.P.C.
