====================================================== CORAM: HONOURABLE MR. JUSTICE DR. ANSHUMAN ORAL ORDER 13-06-2022 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

Let the defect(s), if any, as pointed out by the office be removed within four weeks.

The petitioner seeks bail in connection with Barh P.S. Case No. 206 of 2021 lodged under Sections 379, 414 and 34 of the Indian Penal Code.

As per the allegation made in the F.I.R., total four accused persons were caught by the police; on which allegation of making theft of motorcycle was alleged.

Learned counsel for the petitioner submits that the petitioner is in custody since 22.05.2021, charge-sheet has already been filed in this case. He has further argued that the alleged seizure made in gross violation of Section 100 of Cr.P.C.

He further submits that out of four accused persons; three accused persons were granted bail by the Coordinate Bench of this Court vide orders dated 21.02.2022 and 24.05.2022 passed in Criminal Misc. No. 41315 of 2021 and Criminal Misc. No. 70231 of 2021 respectively. Learned A.P.P. has opposed the prayer for bail of the petitioner.

Considering the fact that petitioner is in custody since 22.05.2021, charge-sheet has been filed and other co-accused have been granted bail, let the petitioner, above named, be granted bail on furnishing bail bond of Rs. 25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate 1st Class, Barh, Patna in connection with Barh P.S. Case No. 206 of 2021. (Dr. Anshuman, J) ved/- U T
