JUSTICE VINOD KUMAR SINHA ORAL ORDER 05-02-2020 Petitioner seeks regular bail in connection with Gopalpur P.S. Case No. 56 of 2019 registered for the offences punishable under Sections 498(A) and 307/34 of the Indian Penal Code and Section 3⁄4 of the Dowry Prohibition Act. Later on, Section 304(B) of the Indian Penal Code was added. Petitioner happens to be the brother-in-law of the deceased. The allegation is of setting her on fire by sprinkling kerosene oil.
Submission of the learned counsel for the petitioner is that with the above allegation, whole family have been made accused in this case. There is no specific allegation against the petitioner and father-in-law of the deceased has already been granted bail by a coordinate bench of this Court by order dated 07.01.2020 passed in Crminal Misc. No. 83682 of 2019. He is in
Patna High Court CR. MISC. No.6606 of 2020(2) dt.05-02-2020 2/2 custody since 24.09.2019. Charge-sheet has already been submitted and there is no change of tampering with the evidence.

Having heard both sides, in view of the submissions made above, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of learned Additional Chief Judicial Magistrate-XI, Gopalganj, in connection with Gopalpur P. S. Case No. 56 of 2019.
