1. Heard learned Senior Counsel for the petitioners and learned Counsel for the State.

The petitioners have filed the present writ application for quashing of the First Information Report of Katihar (Town) Police Station Case No. 04 of 2021, registered for the offences punishable under Sections 420/384/34 of the Indian Penal Code and Sections 3 (i) (r) and (s) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989.

3. Learned Senior Counsel for the petitioners submits that

WJC No.449 of 2021(7) dt.21-09-2023 2/2 the petitioners are the bank officials and the main allegation in the First Information Report is that the petitioners, in order to harass the informant, have shifted the lease premises of the bank belonging to the informant to some other place. The informant also raised some dispute regarding rent of the lease premises. However, learned Senior Counsel submits that during the pendency of this application, the investigation upon the First Information Report has concluded and the police, finding no merit against the petitioners, has submitted final form, exonerating the petitioners from all the allegations levelled in the First Information Report. However, the final form is pending for its acceptance by the learned Special Court.

4. In view of the further development, I am not inclined to interfere with the present application.

5. This application is, accordingly, disposed with liberty to the petitioner to approach this Court if any grievance(s) of the petitioners subsists.
