====================================================== CORAM: HONOURABLE MR. JUSTICE ANJANI KUMAR SHARAN ORAL ORDER 29-02-2020 Heard learned counsel for the petitioner and the learned A.P.P. for the State.
The petitioner apprehends his arrest in connection with Jakkanpur P.S. Case No. 522 of 2018, G.R. No.7445 of 2018 registered for the offences punishable under Sections 273, 275, 276, 420, 414, 120 of the Indian Penal Code and Sections 27(d), 28, 28A, 36 (AC) of Drug and Cosmetics Act, 1940 Amended Act, 2008.
The accusation is that in course of raid at Bus Stand, Patna, 59 cartons of medicines lying, 29 cartons were found genuine and rest 30 cartons were left unclaimed and on one carton, the name of the petitioner was shown. Learned counsel for the petitioner submits that

No.9353 of 2020(2) dt.29-02-2020 2/2 similarly situated co-accused have been granted anticipatory bail by this Co-ordinate Bench of this Court vide order dated 23.10.2019 passed in Cr. Misc. No.53299 of 2019, order dated 21.10.2019 passed in Cr. Misc. No.48909 of 2019 and vide order dated 22.07.2019 passed in Cr. Misc. No.44888 of 2019. Learned counsel for the petitioner further submits that the petitioner runes a retail medicine shop at Ram Nagar Bazar, Madhepura bearing Retail Drug Licence No.15/MDH renewed up to date of which the petitioner is proprietor. In the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs.
20,000/- (twenty thousand) with two sureties of the like amount each to the satisfaction of A.C.J.M., Patna in connection with Jakkanpur P.S. Case No. 522 of 2018, G.R. No.7445 of 2018, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
