JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 01-10-2015 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. The accusation against the petitioner is that he caught hold the informant and made attempt to commit rape. The submission on behalf of the petitioner is that there was previous enmity between the parties and moreover, there is delay in lodging the first information report. The first information report reflects that while the informant was going to attend the call of nature, the petitioner came from behind her and caught hold her with bad intention and therefore, even if the prosecution story is taken in toto then also, it appears that, at best, it is a case of Section 354 of the Indian Penal Code. Accordingly, the above named petitioner is
Patna High Court Cr.Misc. No.46125 of 2015 (2) dt.01-10-2015 2/2 directed to be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Mahila (Bhabua) P.S.
