The petitioner seeks bail in a case registered under Sections 399, 402, 411, 413, 414 of the Indian Penal Code and Sections 25(1-b)a/35 of the Arms Act.

Allegation is that country made pistol, cartridges, mobile phones, motorcycle and key are recovered. It has been submitted on behalf of the petitioner that the petitioner is in custody since 23.11.2018 and has got no criminal antecedent. Charge sheet has been submitted in the case. There is no allegation of tampering of witnesses alleged against the petitioner. Petitioner has falsely been implicated in the present case. The petitioner was not apprehended on the spot. Patna High Court CR. MISC. No.9217 of 2019(2) dt.12-04-2019 2/2 made by co-accused Kundan Kumar. Similar situated other accused has been granted bail vide Cr.Misc.No.9010 of 2019. On behalf of the State, it is submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. VI, Patna City in connection with Khusrupur P.S. case No.297 of 2018.
