The petitioner seeks bail in connection with Patna Kotwali P.S. Case No. 251 of 2012 registered for the offences punishable under Sections 342, 420, 377, 385 and 387/34 of the Indian Penal Code.
The petitioner wants to renew his prayer of bail which was earlier rejected by order dated 22.03.2013 passed in Criminal Miscellaneous No. 31327 of 2012 and again it was dismissed as withdrawn by order dated 14.05.2014 passed in Criminal Miscellaneous No. 30745 of 2013. It is submitted that the trial has not been concluded as yet and the petitioner is suffering in custody since 25.05.2012. The victim has already

The learned A.P.P. opposes the prayer of bail by submitting that the victim was subjected to unnatural offence during his captivity.
Having found no good ground for reconsideration of prayer of bail, again the prayer of bail of the petitioner is rejected.
However, the learned Trial Judge is directed to conclude the trial preferably within three months after taking all the positive steps and keeping the same on day to day basis, failing which the petitioner may be at liberty to renew his prayer for bail.
